Ten Tips for Preparing for Divorce Mediation


Here are some things to think about in preparing for the mediation of your divorce.

1. Envision civil negotiations.
2. Make a checklist for each session.
3. Sketch out a parenting plan or two.
4. Gather financial documents.
5. Strive for fairness in asset and debt division.
6. Draft a monthly budget for expenses.
7. Address the inevitable shortfall.
8. Consider spousal support and calculate child support.
9. Consult a family law lawyer.
10. Monitor your attitude. Stay positive.

Excellent advice for the individual during what is normally a painful and slow process. I'm a divorce lawyer in Phoenix and I do mediations almost exclusively. If every client of mine were to follow this checklist, my work would be 90% done!

I don't think couples put all of what you suggest into mind when they go into mediation, but they should! Mediation saves so much court time and money, but sometimes divorcing couples would rather have at each others' throats.
